This Personal Data Processing Policy aims to provide a framework for the processing of personal data implemented when using all or part of the services available on the Vibes LGBT application, (hereinafter the "Application"), accessible on mobile (iOS and Android) as well as in its web version at https://vibes.lgbt, and in particular when creating an account, logging in, browsing, sharing content and links, sending private messages, and participating in groups and/or events proposed by users of the Application.

As data controller, Vibes Communities ensures compliance with the French Data Protection Act no. 78-17 of January 6, 1978 as amended, as well as Regulation (EU) 2016/679 (General Regulation on the Protection of Personal Data, hereinafter "RGPD") and, more generally, all French and European regulations relating to the protection of personal data.

The RGPD is a reference text on data protection, with the aim of strengthening the protection of individuals' data within the European Union and the European Economic Area. This defines personal data as "any information relating to an identified or identifiable natural person". By way of example, personal data can be an individual's surname, first name or telephone number, but also their occupation or computer IP address.

What categories of data are collected?

When you use the Application, Vibes Communities may collect some of your personal data, either directly from you or via third parties (in particular via the reporting function), such as :

Identification data: first name, pronouns, date of birth, user name, telephone number*, e-mail address, photograph and possibly a copy of an identity document, particularly in the context of a request to exercise rights.

Data relating to gender identity, sexual orientation and/or sexual life: gender(s), sexual orientation(s), dating preferences (gender(s), type of relationship(s) sought), LGBTQIA+ flags.

Personal data: interests, language(s) spoken, answers to compatibility quizzes, reactions to messages and status of other users.

Professional data: occupation.

Location data: city of residence, city of origin, places visited.

Economic and financial data: debit or credit card numbers, invoices, payment orders, discounts and rebates, any other relevant financial data.

Data relating to commercial relations and canvassing: specific customer needs, requests for information and/or documentation, appointment dates and times, data relating to requests to exercise rights.

Data relating to the use of the Application: all data relating to the use of all or part of the Application's services, and in particular the use of certain functionalities, the information to which you have had access, the links integrated and/or consulted, interactions with other users, as well as interactions with advertisements present on the Application.

Data relating to cookies and other tracers: these may be different, depending on the use of the mobile Application or the web application.

Technical data relating to connection and navigation: all technical data such as the date, time and country of connection to the Application, as well as the IP address and operating system of the user terminal.

In general, any data that you decide to share freely via the various free fields available on the Application and, in particular, any data shared via statuses, messages, comments and profile information.

The processing carried out by Vibes Communities falls within the scope, as the case may be, of (i) the performance of a contract or pre-contractual measures, (ii) compliance with a legal or regulatory obligation or (iii) the legitimate interest pursued by Vibes Communities.

In compliance with the RGPD principles of proportionality and minimization, only data that is necessary and relevant to the purposes pursued is collected. As such, Vibes Communities undertakes to collect only the data strictly necessary for the purpose of the processing implemented.

Where the processing carried out by Vibes Communities is based on legitimate interests, Vibes Communities certifies that it has duly weighed its interest in carrying out the processing concerned against your interest in not having your data processed, in particular for reasons relating to respect for your privacy. However, at the end of this balancing exercise, Vibes Communities considered that its interest in carrying out these processing operations prevailed, in particular insofar as a compelling interest obliged it to carry them out and/or insofar as the processing operations concerned presented sufficient guarantees for the protection of your rights and fundamental freedoms.

For more information about the implementation, terms and conditions of this proportionality test, you can contact Vibes Communities by making a request to exercise your rights, under the conditions detailed below, and specifying that the subject of your request concerns this proportionality test.

Who receives your personal data?

When your personal data is collected by Vibes Communities, it may be processed by the staff of Vibes Communities' various internal departments, within the limits of their respective responsibilities, in order to achieve the purposes cited in this Processing Policy.

In addition, Vibes Communities may communicate some of your personal data to authorized third parties, and in particular to external service providers such as social networks, legal and commercial partners and subcontractors, acting on behalf of and on the instructions of Vibes Communities. Your personal data may also be transmitted to the competent administrative and legal authorities, in particular in the context of legal requests.

When your personal data is transmitted to third parties, Vibes Communities certifies that it ensures that the third party recipients will process your personal data in accordance with the requirements relating to French and European standards for the protection of personal data, without any failure on their part being directly or indirectly attributable to Vibes Communities. In this respect, Vibes Communities will ensure that adequate protection measures are put in place on the occasion of these transfers, in accordance with the French Data Protection Act (Loi Informatique et Libertés) and Articles 46 and 49 of the RGPD, in particular through the use of the European Commission's standard contractual clauses for subcontracting, when these data transfers will be to personal data processors, within the meaning of the RGPD.

In any event, access by these recipients to your personal data will remain limited to the categories of data that are strictly necessary for them, for the performance of their duties.

When all or part of your personal data is transferred outside the European Union and the European Economic Community, Vibes Communities undertakes to frame these transfers using appropriate guarantees, and in particular: in compliance with the conditions of the adequacy decisions issued by the European Commission and in particular, in the context of transfers to the United States, after having verified that the recipient company is indeed part of the Data Privacy Framework; through the use of Standard Contractual Clauses of the European Commission, for any transfer to a country that does not have an adequacy decision.

How long is your data kept?

Once your personal data has been collected, it will be kept until the purpose for which it was collected has been fulfilled, before being placed in intermediate storage or destroyed. The exception to this is data used to manage prospects and communication campaigns, which is kept for three years in the active database, from the date of collection or last contact (e.g. deactivation of the user-ice account).

Once the above-mentioned periods have been reached, your data will be stored in an intermediate database, in the form of an archive, for a period that complies with the legal provisions applicable to it and/or will be stored for evidentiary purposes. In the latter case, your data will be kept for a period equal to that of the applicable statute of limitations. If such archiving is not necessary, or on expiry of the above-mentioned periods, your personal data will be deleted.

What rights do you have in respect of your personal data?

Pursuant to the French Data Protection Act (Loi Informatique et Libertés) and the RGPD, you have several rights that you can exercise at any time:

  • Withdrawal of consent: this right allows you to withdraw your consent provided that consent is the legal basis used for the collection of your data (Article 7.3 of the RGPD).
  • Right of access: this right enables you to find out what data has been processed and to receive a copy, sent to the e-mail address of your choice (Article 15 of the RGPD).
  • Right of rectification: this right enables you to correct inaccurate or incomplete information about yourself (article 16 of the RGPD)
  • Right to erasure: this right allows you to request the erasure of data concerning you (Article 17 of the RGPD)
  • Right to limit the processing of your data: this right allows you, under certain conditions, to request the temporary suspension of all or part of the processing carried out on your data (Article 18 of the RGPD)
  • Right to portability: this right allows you, under certain conditions, to request the recovery of your data or its transmission to a third party (Article 20 of the RGPD)
  • Right to object to the processing of your data: this right allows you to refuse the use of your data: (i) when such processing has as its legal basis the legitimate interest of the Data Controller, (ii) if you have a legitimate reason for refusing such processing and (iii) if no compelling and legitimate grounds require the Data Controller to continue processing your data (Article 21 of the RGPD).

In addition, you have the right to define directives regarding the fate of your data after your death. For more information on rights, you can consult the website of the Commission nationale de l'informatique et des libertés (CNIL).

What security measures are in place to protect your data?

Vibes Communities implements a number of measures to ensure the security of the Application, in particular the use of an SSL certificate, materialized by the https address of the Application, in its web version. In addition, the administrator accounts enabling access to the Application are password-protected, and only Vibes Communities' internal department has access to them. Furthermore, in order to reinforce the security and performance of the Application, updates are carried out manually. If necessary, you are invited to update the Application yourself via the application store of your choice (App Store for iOS and Google Play for Android).
